User Agreement
This User Agreement (“Terms”) governs your access to and use of the Hauslain Real Estate website, mobile experiences, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms and our [Privacy Policy]. If you do not agree, do not use the Services.
1) Who we are
“Hauslain Real Estate” (“Hauslain,” “we,” “us”) operates an online platform for advertising, discovering, and in some cases facilitating real estate sales and leases in Papua New Guinea (PNG). Unless expressly stated in writing for a specific listing, Hauslain is not a party to any sale/lease; agreements are solely between the buyer/tenant and seller/landlord (or their licensed agents).
2) Eligibility & accounts
You must be at least the age of majority in PNG and have legal capacity to contract.
You are responsible for your account credentials and all activity under your account. Notify us immediately of unauthorized use.
We may require identity checks (KYC/AML) where appropriate.
3) Listings & transactions
Accuracy. Listing content (price, features, photos, availability, titles, dimensions, land status, utility connections, permits, etc.) is provided by sellers/landlords/agents and is for general information only. We do not guarantee accuracy or completeness; perform your own due diligence (site inspections, title searches, surveys, legal/financial advice).
No advice. Information on the Services is not legal, financial, valuation, engineering or tax advice.
Inspections & safety. Attend inspections/viewings at your own risk and follow all safety directions.
Offers & contracts. All offers are non-binding until formalized in a written contract signed by the parties. Contract templates, if provided, are examples only.
4) Your content & license
You retain ownership of content you submit (text, images, documents, floor plans, videos, logos).
You grant Hauslain a worldwide, royalty-free, non-exclusive license to host, use, reproduce, modify for formatting, and display your content in connection with the Services and marketing them.
You warrant you have the rights to post the content and that it does not infringe any third-party rights or PNG law.
5) Prohibited uses
You agree not to:
Post false, misleading, defamatory, obscene, illegal, or infringing content; impersonate others.
Circumvent security, interfere with the site, or deploy scraping, bots, or bulk harvesting without our written consent.
Upload malware or attempt to gain unauthorized access.
Post listings without authority (e.g., if you are not the owner or appointed agent).
6) Fees & payments (if applicable)
We may charge listing/promotional or success-based fees, disclosed at checkout or in a written agreement.
Fees are stated in PGK unless noted otherwise, are non-refundable except as required by law, and may be subject to taxes.
Third-party processors (e.g., payment gateways) may apply their own terms and charges.
7) Communications & marketing
By contacting us or creating an account, you consent to receive service messages (email, SMS, WhatsApp, phone) related to your activity.
You may opt in to marketing; you can opt out at any time. See our Privacy Policy for details.
8) Intellectual property
The Services (site design, software, databases, trademarks, logos—excluding user content) are owned by Hauslain or its licensors and protected by law.
Do not copy, modify, distribute, or create derivative works except as permitted by these Terms or with our written consent.
9) Third-party links & tools
The Services may link to external sites or tools. We do not endorse and are not responsible for their content or practices. Use them at your own risk and review their terms and privacy policies.
10) Privacy
Our Privacy Policy explains how we collect and use personal data. By using the Services, you consent to those practices.
11) Warranties & disclaimers
The Services are provided “as is” and “as available.” We make no warranties (express or implied) including merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant continuous, error-free, or secure operation, or that listings will be accurate, available, or achieve any specific outcome.
12) Liability limits
To the fullest extent permitted by PNG law:
Hauslain is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, loss of profits, data, goodwill, or business interruption.
Our total liability for claims arising from or related to the Services will not exceed the greater of PGK 500 or the amount you paid to us in the 3 months before the claim.
Nothing limits liability for death or personal injury caused by our negligence or other liability that cannot be excluded under law.
13) Indemnity
You agree to indemnify and hold harmless Hauslain, its officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your content; (b) your use of the Services; (c) your breach of these Terms or applicable law; or (d) your transactions with third parties.
14) Takedowns & complaints
If you believe content infringes your rights or violates these Terms, contact us with details and supporting documents. We may remove content or suspend accounts at our discretion.
15) Suspension & termination
We may suspend or terminate access (with or without notice) if we believe you violated these Terms, created risk or legal exposure, or for operational reasons. You may stop using the Services at any time. Some provisions (e.g., IP, fees, disclaimers, liability limits, indemnity, governing law) survive termination.
16) Changes to the Services and Terms
We may modify the Services or these Terms at any time. Changes take effect when posted with the “Last updated” date revised. Material changes may be highlighted on the site. Continued use after changes means you accept the updated Terms.
17) Governing law & disputes
These Terms are governed by the laws of Papua New Guinea. You and Hauslain agree to first attempt to resolve any dispute informally within 30 days. If unresolved, the dispute will be brought exclusively in the courts of Port Moresby, NCD, and you consent to their jurisdiction and venue. Nothing prevents either party from seeking urgent injunctive relief.
18) Miscellaneous
Entire agreement. These Terms plus any service-specific terms and the Privacy Policy are the entire agreement between you and us.
Severability. If a provision is unenforceable, the remainder remains in effect.
No waiver. Our failure to enforce a provision is not a waiver.
Assignment. You may not assign or transfer your rights without our consent; we may assign to an affiliate or in a merger/asset sale.
Force majeure. We are not responsible for delays or failures due to events beyond our reasonable control.
